Name of procedure: Register marriage having foreign elements in border area

Authority: People’s Committee of commune/ward/town

Process:

- Submit dossier in commune People’s Committee, permanent residence of Vietnamese citizen in border area;  

- Commune People’s Committee has responsibility for verifying dossier and posting the marriage in the head office of the Committee and sending the document enclosing 01 set of dossier of marriage registration to Justice Department for opinion.

- Justice Department considers the dossier of marriage registration and replies in writing to commune People’s Committee.

- On the basis of opinion of Justice Department, commune People’s Committee decides the marriage registration and holding the wedding.  

Method: Submit directly dossier in commune People’s Committee.

Content of Dossier:

- Vietnamese citizen must submit Statement of marriage registration according to the form;

- Citizen of neighbor country must submit Statement of marriage registration according to the form, confirmed not over 06 months until date of receiving dossier of the competent authority of neighbor country to confirm that at present the person concerned is the person who has not had wife or husband.

When submit dossier, the person concerned must present the following papers:

a) Vietnamese citizen must present border ID card; in case, it have no border ID card, must present papers to prove the permanent residence in border area enclosing other personal papers of the person concerned to check.

b) Citizen of the neighbor country must present personal papers which the competent state authority of neighbor country issues to the citizen of the country residing permanently in border area with Vietnam; in case there have no personal papers, must present papers to prove the permanent residence in border area with Vietnam enclosing other personal papers of the person concerned to check.

c) For person who had wife or husband before but divorced or the wife or husband died or declared to be died, subject to specific case, the person concerned must present the sentence, decision came into legal effect on allowing to divorce or Death certificate of the wife or husband.

Number of documents: 02 sets

Time of execution:

- Within 15 days since receiving enough the legal papers and fee, commune People’s Committee investigates dossier and posts the marriage within 07 continuous days in the head office of the committee. After that, commune People’s Committee sends the document enclosing 01 set of dossier of marriage registration to Justice Department. Within 15 days since receiving the document of asking opinion of commune People’s Committee, Justice Department considers the dossier of marriage registration and replies in writing to commune People’s Committee. 

- Within 07 days since receiving the opinion of Justice Department, commune People’s Committee decides the marriage registration and holds the wedding as the case of marriage registration between Vietnamese citizens in the country with each other according to the regulation on registering the civil status.
